Article 1 — Definitions
• Seller: TimePolish, registered with the Dutch Chamber of Commerce under number 99210924
• Customer: any natural person or legal entity placing an order with the Seller.
• Consumer: a Customer who is a natural person not acting in the course of a profession or business.
• Agreement: any agreement between the Seller and the Customer for the sale and delivery of products.
• Website: www.timepolish.com.
Article 2 — Applicability
These general terms and conditions apply to every offer made by the Seller and to every agreement concluded between the Seller and the Customer through the Website. Before an agreement is concluded, these terms are made available to the Customer electronically.
Article 3 — Offers and Prices
All offers on the Website are without obligation. Prices are stated in euros and include VAT, unless stated otherwise. Shipping costs, if applicable, are shown separately before checkout. Obvious errors or mistakes in offers and prices are not binding on the Seller.
Article 4 — Conclusion of the Agreement
The agreement is concluded when the Customer accepts the offer and completes the order process. The Seller confirms receipt of the order by email without delay. Until this confirmation has been sent, the Customer may dissolve the agreement.
Article 5 — Payment
Payment is made through the payment methods offered on the Website. The Customer must pay the full amount at the time of ordering, unless otherwise agreed. The Customer must report inaccuracies in payment details to the Seller without delay.
Article 6 — Delivery
The Seller will process and ship accepted orders with due speed, in accordance with the Shipping Policy published on the Website. Orders placed on business days before the stated cut-off time are shipped the same day; delivery within Europe generally takes place the next business day. The place of delivery is the address the Customer has provided. Delivery periods are indicative; exceeding a delivery period does not entitle the Customer to compensation, though the Customer may set a reasonable additional period and dissolve the agreement if delivery still does not occur.
Article 7 — Right of Withdrawal
A Consumer may dissolve the agreement without giving reasons within 14 days after the day of receiving the product. During this period, the Consumer shall handle the product and packaging with care and only unpack or use it to the extent necessary to assess whether they wish to keep it. The details and conditions of withdrawal are set out in the Return Policy on the Website. Products that have been opened or used beyond what is necessary to inspect them, and which cannot be resold for reasons of hygiene or product integrity, may be excluded from the right of withdrawal or subject to a reduction in the refund.
Article 8 — Conformity and Warranty
The Seller guarantees that products comply with the agreement, the specifications stated in the offer, and reasonable requirements of soundness and usability. Statutory warranty rights under Dutch and European consumer law remain fully applicable. The warranty does not cover defects caused by incorrect use, failure to follow product instructions, or normal wear and tear.
Article 9 — Liability
The Seller's liability is limited to the amount paid for the product in question, except in cases of intent or gross negligence, and without prejudice to mandatory statutory consumer rights. The Seller is not liable for damage to timepieces resulting from use of the products contrary to the provided instructions.
Article 10 — Complaints
Complaints about the performance of the agreement must be submitted to the Seller within a reasonable time after the Customer has discovered the defect, fully and clearly described, via support@timepolish.com. The Seller will respond within 14 days of receipt.
Article 11 — Personal Data
The Seller processes personal data in accordance with the General Data Protection Regulation (GDPR) and its Privacy Policy, available on the Website.
Article 12 — Applicable Law and Disputes
Agreements between the Seller and the Customer are governed exclusively by Dutch law. Disputes will be submitted to the competent Dutch court, unless mandatory law designates another court. The applicability of the Vienna Sales Convention (CISG) is excluded.
Article 13 — Amendments
The Seller may amend these terms and conditions. Amendments take effect only after publication on the Website and do not apply to agreements already concluded.
